Terms & Conditions

Your contract is with World of Travel Limited, a fully bonded tour operator member of ABTA (Member No. V7371).

1. When you make your booking you must complete an ABTA recognised booking form, accepting on behalf of all your party the terms of these booking conditions and pay a deposit of £100 per week for accommodation and 25% deposit required for Longboat Homes. All monies paid to your travel agent are held by him on your behalf until we issue our confirmation invoice. Thereafter your travel agent holds the monies on our behalf. A contract will exist when we issue our confirmation invoice.

2. The balance of the price of your holiday must be paid at least 8 weeks before your departure date. If the balance is not paid in time we reserve the right to cancel your holiday, retain your deposit and apply the cancellation charges set out in paragraph 4 below.

3. If, after our confirmation has been issued, you wish to change to another of our holidays or change departure date, we will do our utmost to make the changes, provided that notification is received in writing at our offices from the person who signed the booking form, or from their travel agent, at least 8 weeks before departure. This must be accompanied by a payment of £25.00 per person to cover our administration costs. Alterations cannot be made within 8 weeks of departure and any such request for an alteration will be treated as a cancellation of the original booking and will be subject to the cancellation charges set out in paragraph 4 below. Please note that certain travel arrangements cannot be changed after a reservation has been made and any alteration request will incur a 100% cancellation charge. We cannot guarantee to be able to accommodate all changes.

4. You, or any member of your party, may cancel your holiday at any time providing that the cancellation is made by the person signing the booking form and is communicated to us in writing via the travel agent with whom you made your booking. As this incurs administrative costs, we will retain your deposit and in addition may apply cancellation charges up to the maximum shown below.

Note: If the reason for cancellation is covered under the terms of an insurance policy, you may be able to reclaim these charges.

5. If you have a problem during your holiday, please inform the relevant supplier (e.g. hotel) or resort representative immediately who will endeavour to put things right. If your complaint cannot be completely resolved locally, please follow this up within 28 days of your return home by writing to our office at 101-103 New Road Side, Horsforth, Leeds LS18 4QD, giving your original booking reference number and all other relevant information. It is therefore a condition of this contract that you communicate any problem to the supplier of the services in question, whilst in resort. If you fail to follow this simple procedure, we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the problem. It is unlikely that you will have a complaint that cannot be settled amicably between us. However, disputes arising out of, or in connection with this contract which cannot be amicably settled, may (if you wish) be referred to Arbitration under a special scheme, which though devised by arrangement with the Association of British Travel Agents, is administered quite independently by the Chartered Institute of Arbitrators. The scheme, details of which can be supplied on request, provides for a simple and inexpensive method of Arbitration on documents alone with restricted liability on the customer in respect of costs. The scheme does not apply to claims for an amount greater than £1500 per person, or £7500 per booking form. Neither does it apply to claims which are solely or mainly in respect of physical injury or illness or the consequences of such injury or illness. If you elect to seek redress under this scheme, written notice requesting Arbitration must be made within 9 months after the scheduled date of return from holiday.

6. Approximately 9 weeks prior to your departure we shall send you the Final Invoice including all (if any) surcharges. Any increases after receipt of the final invoice will be absorbed by us provided you have paid your account in full. In return for this guarantee no refund will be granted if the £ sterling improves in value against foreign currencies prior to your departure. The price of your holiday is subject only to surcharges on the following items. Government action, currency fluctuation and increases in scheduled airfares and/or fuel surcharges applied by the airline. Holiday prices have been calculated against costs as known on 5th March 1999 and the exchange rates listed in the Financial Times (GB £1 = US $1.6097). When a surcharge is required, we will inform you of the reason and amount as follows: We will absorb an amount equivalent to 2% of the holiday price (the holiday price is the amount quoted to you at the time of booking and will include any surcharges known to exist at that time) excluding insurance premiums and any amendment charges. Only amounts in excess of 2% will be passed on to you. If this means you paying more than 10% extra on the holiday price, you will be entitled to cancel your holiday with a full refund of all monies paid except for any premium paid to us for holiday insurance and any amendment charges. Should you decide to cancel because of this, you must exercise your right to do so in writing within 14 days from the issued date printed on the invoice.

7. It is unlikely that we will have to make any changes to your holiday, but we do plan the arrangements many months in advance.
Occasionally changes may be made and we reserve the right to do so at any time. Most of these changes are minor, and we will advise you or your travel agent at the earliest possible date. Final details will be shown on your tickets. If a major change becomes necessary, we will inform you or your travel agent as soon as reasonably possible if there is time before departure. When a major change occurs provided it does not arise form circumstances amounting to force majeure (see below), you will have the choice of either accepting the change of arrangements, taking another available holiday from us, or cancelling your holiday and receiving a full refund. In all cases we will pay compensation as detailed below.

Important Note: Compensation will not be payable if we are forced to cancel or in any way change your holiday due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other circumstances amounting to force majeure.

8. We reserve the right in any circumstances to cancel your holiday and any holidays operating subject to a minimum number of participants. However, in no case will we cancel your holiday less than 8 weeks before the scheduled departure date except for reasons of force majeure or failure on your part to pay the final balance. In circumstances where we are unable to provide the holiday booked, we will return to you all monies paid or offer an alternative holiday of comparable standard and if a cancellation occurs within 8 weeks of departure, compensation on a similar scale to that shown in paragraph 7.

9(i). We accept responsibility for ensuring the holiday which you book with us is supplied as described in this brochure and the services offered reach a reasonable standard. If any part is not provided as promised, we will pay you appropriate compensation if this has affected the enjoyment of your holiday. We accept responsibility for the acts and /or omissions of our employees, agents and suppliers except where they lead to death, injury or illness. Our liability in all cases shall be limited to maximum of £3000.

9(ii). We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, together with our suppliers and sub-contractors, servants and/or agents of the same whilst acting within the scope of, or in the course of their employment in the provision of your holiday. We will accordingly pay to our clients such damages as might have been awarded in such circumstances under English Law.

9 (iii). In respect of carriage by air, sea and rail and the provision of accommodation, our liability in all cases will be limited in the manner provided by the relevant international convention.

10. If any client suffers death, illness or injury whilst overseas arising out of an activity which does not form part of the foreign holiday arrangement or excursion arranged through us, we shall, at our discretion offer advice, guidance and assistance to help you in resolving any claim you may have against a third party, provided we are advised of the incident within 90 days of the occurrence. Where legal action is contemplated our authority must be obtained prior to commencement of proceedings and be subject to your undertaking to assign any cost recovered or any benefits received under an appropriate insurance policy to ourselves. Our costs in respect of the above on behalf of you and your party shall not exceed £5000.00 in total.

11. This contract is made on the terms of these booking conditions which are governed by English Law and both parties shall submit to the jurisdiction of English Courts at all times.

In our opinion it is vital that you are fully insured whilst travelling in the U.S.A.

We have included a selection of resorts in the brochure that we are sure you will be most satisfied with. We do, however, have access to literally hundreds of more hotels and resorts in Florida, so if your favourite is not included inside these pages, or you are looking to book something a little different, please contact us, and we will be delighted to assist you.
